You agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the jurisdiction of such courts.

Informal Resolution

Before filing a claim, you agree to contact us at support@selectchoicemart.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.

Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY – IT AFFECTS YOUR LEGAL RIGHTS

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except:

• Small claims court disputes (up to $10,000)
• Claims for injunctive or equitable relief
• Intellectual property disputes

Arbitration Rules:

• Arbitration will be conducted by the American Arbitration Association (AAA)
• AAA’s Commercial Arbitration Rules will apply
• Arbitration will take place in Albuquerque, New Mexico
• Each party pays its own attorneys’ fees and costs
• The arbitrator’s decision is final and binding
• Judgment on the award may be entered in any court

Class Action Waiver

YOU AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

You waive any right to:

• Participate in a class action lawsuit
• Act as a class representative
• Participate in consolidated or representative proceedings

Opt-Out

You may opt out of this arbitration agreement by sending written notice to us within 30 days of first using the Site. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.

Termination

Termination by You

You may stop using our Site at any time. To close your account, contact us at support@selectchoicemart.com.

Termination by Us

We reserve the right to suspend or terminate your access to the Site, with or without notice, for:

• Abusive or disruptive behavior

Effect of Termination

These Terms, along with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and SelectChoiceMart regarding use of the Site.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Waiver of any breach does not waive any subsequent breach.

Assignment

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

• Labor disputes or strikes
• Supply chain disruptions
• Pandemics or epidemics
• Utility failures
• Internet or telecommunications failures

No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and SelectChoiceMart.

Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

Electronic Communications

You consent to receive communications from us electronically, including:

• Email notifications
• Messages posted on the Site
• Other electronic communications

Electronic communications satisfy any legal requirement that communications be in writing.
